Can I Go the Canada or Mexico to Get the F-1 Visa Quickly at a Consular Post

Help Desk:

I am currently unemployed with B-2 visa, and want to change to F-1 visa. Can I go the Canada or Mexico to get the F-1 visa quickly at a consular post, because of the slow USCIS process inside the U.S.?

Answer:

You can go the Canada or Mexico to get the F-1 visa quickly at a consular post, but the potential problem for doing this is that you may not come back to U.S. if your F-1 application is rejected by a consular post abroad according to the contiguous territory rule.

In this situation, you may need to go back to your home country to apply for the F-1 visa there. F-1 visa is a nonimmigrant visa, which requires you to show your nonimmigrant intent and strong family ties to your home country.
