I am a political asylee, and my I-485 application is pending for more than one year. My son will be age 21 next year February. I want to know how to let USCIS expedite the processing of my I-485 application, prior to my son's turning of age 21 to avoid the age-out.
Answer:
USCIS always says that it will make every effort to expedite the processing of the I-485 for dependent children who are within one year of reaching the age of 21. These filings are expedited through the process in order to be adjudicated prior to the applicant turning age 21.
But the refugee and asylee applicants do not age-out and therefore will not be expedited. Also, the asylee adjustment applicants should not be expedited due to the cap considerations. The asylee can receive asylum status after 21, thereby allowing continued processing of their application.
